There’s a new serial killer out there and it’s called negligence. Every day there are multiple, preventable deaths and injuries that happen on job sites around the world. Nationally, OSHA has been cracking down, but we are also starting to see a rise in state and local county involvement. They’re going after these companies as any normal prosecuting attorney would- with criminal charges.

In an article from EHS Today we learn that for the first time, Washington’s King County prosecuted and charged the owner of Seattle-area Alki Construction with manslaughter after one of his workers died negligently in a trench collapse.

“There are times when a monetary penalty isn’t enough,” said L&I Director Joel Sacks. “This company knew what the safety risks and requirements were, and ignored them. The felony charges show that employers can be held criminally accountable when the tragedy of a preventable workplace death or injury occurs.”

And it doesn’t just stop there. An article from The New York Times outlines a case where an owner of two Brooklyn construction companies, was charged with manslaughter, after he ignored complaints of a faulty retaining wall that eventually lead to an employee’s death.

“The companies’ owner, Michael Weiss, 47, was also charged with criminally negligent homicide in the death of the laborer, Fernando Vanegaz, an immigrant from Ecuador. In an indictment issued in State Supreme Court in Brooklyn, Mr. Weiss was further accused of reckless endangerment, assault, grand larceny, tax fraud and falsifying business records. He could face up to 15 years in prison if convicted of the charges.”

These are just two examples of accidents that happen multiple times daily. The construction field is a dangerous place and safety MUST become a priority.
